On Wednesday, the Delhi High Court sent out a notice after Karisma Kapoor’s two children filed a plea asking for their share of the assets left behind by their late father, Sunjay Kapur.
Priya Kapur asked to submit asset list
Justice Jyoti Singh directed Sunjay Kapur’s third wife, Priya Sachdeva Kapur—who is the main defendant in the case—to submit a full list of his movable and immovable assets. This order came after Karisma Kapoor’s children alleged that Priya had forged a will to take over their father’s property.The court issued a notice, giving Priya two weeks to file her reply and another week for the rejoinder. It also asked her to declare all assets as of June 12.The case will come up again on October 9, when the court will decide on Karisma Kapoor’s children’s request for an interim injunction.
Confidentiality concerns addressed
According to a report in Bar and Bench, the court also questioned Priya Kapur on why she was unwilling to share a copy of the will with Karisma Kapoor’s children. The judge noted that there was no reason to withhold it, adding that a non-disclosure agreement or a confidentiality arrangement could easily be put in place, just as is often done in intellectual property cases.
Allegations of forgery
The siblings have accused their stepmother, Priya Kapur—Sunjay’s third and last wife—of forging his will in an attempt to take full control of his assets.Karisma Kapoor and Sunjay Kapur were married for 13 years, from 2003 to 2016, before they divorced. The two share a son and a daughter.Represented by their mother, Karisma Kapoor, the children told the court that they were unfairly left out of Sunjay Kapur’s estate after his sudden death in June this year while he was in the United Kingdom.The suit lists Priya Kapur, her minor son, Sunjay’s mother Rani Kapur, and the alleged executor of the will, Shradha Suri Marwah, as defendants.At the heart of the dispute is a will dated March 21, 2025, which reportedly leaves Sunjay Kapur’s entire personal estate to his third wife, Priya Sachdeva Kapur.The children allege that their stepmother, Priya Kapur, along with two associates, Dinesh Agarwal and Nitin Sharma, kept the will hidden for more than seven weeks before finally presenting it at a family meeting on July 30.
Claims of forgery and suspicious circumstances
According to the plea, the will is not genuine but forged and fabricated. The children argue that the document being presented as their father’s will is neither legal nor valid and is surrounded by suspicious circumstances. They point out that they have not been shown the original will, nor have they been given a copy of it.
Children seek recognition as legal heirs
The suit claims that Priya Kapur’s actions show an attempt to take full control of Sunjay Kapur’s estate, leaving out the other legal heirs. The children have asked the court to recognize them as Class I legal heirs and to issue a decree of partition, giving each of them a one-fifth share of their father’s assets.As a temporary measure, the children have requested that all of Sunjay Kapur’s personal assets be frozen until the dispute is resolved.
